The deposit is the first number to check when renting in Milan, and it is capped: Article 11 of Law 392/1978 sets a maximum of three months’ rent, and it must earn legal interest paid to you every year. Registration tax on a residential lease is 2% of the annual rent, minimum €67, plus €16 stamp duty per four pages. Both are jointly liable and split it in half in practice. Under cedolare secca both taxes disappear and the landlord gives up ISTAT rent increases while the option runs, so ask which regime applies.

Agency fees are not fixed by law, so get the figure in writing before you view. Check the agent is registered: under Article 6 of Law 39/1989 only an intermediary listed with the Chamber of Commerce may claim a commission, and one who is not has no enforceable right to a cent. Registering the Lease and Your Milan Residency
