Milan is Italy’s most expensive rental city, good flats go in days, and everything is in legal Italian. Italian rent law protects you well once the contract is registered, whatever passport you hold. The idealista research office report of 8 July 2026 put the citywide average at €23.3 per square metre per month in the second quarter of 2026, flat on the quarter and down 1.5% year on year. The canone concordato is worth asking for. Milan is on the Agenzia delle Entrate list of high-demand municipalities, so a landlord using it pays cedolare secca at 10% instead of 21%, and the rent must sit inside the city’s agreed bands. It needs a bilateral attestation from a signatory association. Deposits, Agency Fees and Lease Taxes
The deposit is the first number to check when renting in Milan, and it is capped: Article 11 of Law 392/1978 sets a maximum of three months’ rent, and it must earn legal interest paid to you every year. Registration tax on a residential lease is 2% of the annual rent, minimum €67, plus €16 stamp duty per four pages. Both are jointly liable and split it in half in practice. Under cedolare secca both taxes disappear and the landlord gives up ISTAT rent increases while the option runs, so ask which regime applies.
Agency fees are not fixed by law, so get the figure in writing before you view. Check the agent is registered: under Article 6 of Law 39/1989 only an intermediary listed with the Chamber of Commerce may claim a commission, and one who is not has no enforceable right to a cent. Asking for the REA number removes most of the fake-agent risk from renting in Milan.
Registering the Lease and Your Milan Residency
Registration is the landlord’s legal duty, not yours, and skipping it is what makes renting in Milan go wrong later.
- Get a codice fiscale from the Agenzia delle Entrate first. No contract can be registered without one.
- The landlord registers the lease on the RLI form within 30 days of signing, then tells you and the building administrator within 60 days.
- Keep the registration receipt. You will be asked for it repeatedly.
- Declare your residency to the Comune di Milano within 20 days of moving, via the national ANPR portal. You need the flat’s cadastral details and your title to occupy it, both from the lease.
If a landlord never registers, Article 13 of Law 431/1998 is on your side: the court brings the tenancy into line, caps the rent at the legal minimum and refunds overpayments. Any side deal setting a higher rent than the registered contract is void.
Rental Scams to Avoid When Renting in Milan
Scams here follow a few scripts, and nearly all end the same way: send money before you have seen the flat.
- The absent owner. A flat under the district rate, an owner conveniently abroad, a deposit wired to hold it. Never pay for a place you have not viewed.
- The unregistered lease. Cash rent, no receipts. It is illegal, it blocks your residency, and it leaves you without an official address.
- The fake agent. Commission charged with no Chamber of Commerce registration. Ask for the number, then check it.
- The copied listing. Real photos lifted from a genuine advert, reposted cheaper. Reverse-search the images and view with whoever will sign the contract.
